Terms of Service
Effective Date: November 28, 2025
Legal Entity: Online Fingerprint Authentication (Pty) Ltd ("Onfinga")
Jurisdiction: Republic of South Africa (with optional global jurisdiction clause)
1. Agreement to Terms
By registering for or using Onfinga’s services, you (“Operator”, “you”, “your”) agree to be bound by these Terms of Service (“Terms”). These Terms form a legally binding agreement between you and Online Fingerprint Authentication (Pty) Ltd, a private company registered in South Africa.
If you are accepting these Terms on behalf of a company, you represent that you have authority to bind that company.
2. What Onfinga Does
Onfinga provides direct-booking short-term rental operators and vacation rental managers with a confirmation layer that records what a guest saw, accepted, and confirmed before payment. Our services include:
- Creation of Purchase Confirmation Records, also referred to as Booking Records
- Timestamped records of guest confirmation before payment
- Operator dashboard access for creating, viewing, and retrieving records
- PDF and JSON retrieval of confirmation records for operator review and documentation
Onfinga is not:
- A payment gateway
- A financial services provider (FSP)
- A processor or holder of card data
- A personal data marketplace
3. Operator Responsibilities
By using Onfinga, you agree to:
- Use the service only for lawful and legitimate booking workflows
- Maintain the security of your API keys and access credentials
- Notify guests where appropriate that an additional confirmation step is part of your booking or payment flow
- Comply with applicable data protection laws including: POPIA (South Africa); GDPR (European Union); CCPA (California, USA); ECTA and the CPA (South Africa)
- Provide accurate and truthful booking metadata
- Ensure your property details, stay dates, pricing, fees, policies, and booking terms are current
- Maintain any booking links, payment links, webhooks, or endpoints used in connection with Onfinga
4. Data & Privacy
You retain control over the booking metadata you provide. Onfinga processes the information needed to create, store, and retrieve Purchase Confirmation Records. Onfinga does not process payments or store card data. See our full Privacy Policy for more detail.
5. Billing & Fees
Billing Cycle
- The Founding Pilot is billed at USD $99 per month unless otherwise agreed in writing.
- The Founding Pilot includes 75 Purchase Confirmation Records per monthly billing period.
- Additional records above the included monthly allowance are billed at USD $0.75 per record.
- Subscription billing and usage-based charges are processed through Paddle as merchant of record.
- You may cancel the Founding Pilot at any time. Cancellation stops future subscription renewals but does not automatically refund prior fees or completed record usage.
- Onfinga reserves the right to suspend service for overdue, failed, or disputed payments.
Refunds
- Onfinga does not offer refunds for completed Purchase Confirmation Records.
- You will not be charged overage fees for failed, abandoned, or uncompleted confirmation attempts.
- If you believe you were incorrectly billed, contact billing@onfinga.net within 14 days.
6. Termination
You may terminate your account at any time via your dashboard or by contacting us in writing.
Onfinga may suspend or terminate your access if:
- You materially breach these Terms
- You fail to pay an invoice within the payment window
- We are legally required to do so
Upon termination, your historical records may be retained for up to 24 months for legal, audit, billing, or compliance purposes, unless a longer period is required by law or agreed in writing.
7. Intellectual Property
Onfinga retains all ownership rights, title, and interest in:
- The platform, dashboard, and APIs
- Any software, scripts, designs, or documentation provided
- The structure and format of Purchase Confirmation Records and related outputs
You may not reverse engineer, decompile, or duplicate our platform.
Ownership and Custody of Purchase Confirmation Records
1. Record Custody
Purchase Confirmation Records generated by Onfinga — including, but not limited to, guest confirmation details, timestamps, device or session metadata where applicable, and integrity information — are retained by Onfinga to preserve record integrity and auditability.
2. Purpose of Custody
We retain custody of these records to help ensure their integrity, consistency, and retrievability.
3. Operator Access and Usage Rights
As an operator, you are granted access to records associated with your account. You may download, submit, store, or otherwise use these records for business operations, dispute review, guest support, or documentation purposes.
4. Limitations
While you have usage rights, you may not alter, tamper with, or misrepresent Onfinga-generated records. Doing so may void their evidentiary value and violate applicable laws.
5. Data Privacy and Protection
Onfinga does not sell, share, or monetize Purchase Confirmation Records. Records are processed and stored in accordance with relevant privacy laws and our Privacy Policy.
8. Liability & Warranties
No Warranty
Onfinga is provided “as is” and “as available”. We make no guarantees that:
- The service will be uninterrupted or error-free
- Dispute outcomes will favor you
- Chargebacks, disputes, fraud, or guest claims can be prevented
Limitation of Liability
To the maximum extent permitted by law:
- Onfinga’s total liability is capped at USD $100 or 1 month of fees paid, whichever is lower
- We are not liable for indirect, consequential, punitive, or incidental losses
- We do not assume liability for payment processor actions, platform actions, guest conduct, or third-party decisions
9. Dispute Resolution & Jurisdiction
For South African Operators:
Any disputes shall be subject to the jurisdiction of the Western Cape High Court.
For International Operators:
Onfinga may elect to apply:
- The jurisdiction where the operator is based, or
- A neutral international arbitration forum
Note: This clause helps operators avoid conflicting legal exposure while preserving Onfinga’s ability to defend itself fairly.
10. Acceptable Use Policy (AUP)
You may not use Onfinga to:
- Validate illegal or deceptive bookings
- Circumvent payment verification procedures
- Interfere with or manipulate Purchase Confirmation Records
- Attempt to fake, falsify, or suppress dispute data
Onfinga reserves the right to suspend any account violating our AUP without notice.
11. Changes to These Terms
We may update these Terms periodically. We will notify operators of material changes via email or via the dashboard. Continued use of the service after changes take effect constitutes acceptance.
